Main goals and objectives:
In accordance with Company Compliance Strategy and Compliance Standards, the principal duties for this function are
1) To set up and implement an effective Compliance Management System (CMS)
2) Unified alignment and interlinking of CMS activities in China as well as integration of new companies into Group's CMS, including the operational implementation and monitoring of all CMS-related activities
The measures and policies established by Compliance altogether aim to ensure the legally compliant conduct of legal representatives and company employees, as well as that of any third parties.
Alongside these principal duties, the function also involves control and mediation duties for all group companies in China. In the Joint Ventures, this will be carried out in close coordination and agreement with the respective managers and appointed persons responsible for compliance.
Additionally, in the framework of agreed information and networking responsibilities, the function ensures the collaboration of all companies for Group brands represented in China regarding compliance content.
Following on from this is the important objective of preventing negative effects as a result of "non-compliance" by a company (damage to reputation, material/immaterial damage, damage claims by third parties etc.). To this end, close coordination with the Internal Audit, Legal Affairs and Human Resources Departments is required, as they are responsible for the investigative and reactive elements of the CMS.
Within the framework of risk management, the function contributes to corporate management and to sustainable corporate success (early risk detection/effectiveness of CMS, Compliance) and influences the relevant reporting on sustainability in the area of compliance (e.g. Dow Jones Index).
Supporting the development, establishment and operation of an effective CMS in relevant departments (risk oriented) and companies
Business Consultants reporting to the company Compliance Officer
Unified alignment and interlinking of CMS activities in China
Joint Venture support ; roll-out and integration of new companies into the scope of the Compliance Management System; operational support and consulting during initial process set-up and consulting for the Joint Venture for compliance-related questions
In coordination with the respective managers, support the company Compliance Officer in planning and implementing the central medium/internal guidelines for directly addressing legally compliant conduct, in order to support employees and managers in carrying out day-to-day operational activities
Advise/Support the Compliance Officer and company managers in developing, establishing and operating an effective CMS in relevant departments (risk oriented) and group companies
Support the company Compliance Officer in conceptualizing and implementing dedicated consulting tools for group companies
Plan and implement communication activities using a company-specific, risk-oriented and target-group-specific approach in order to ensure implementation of the Compliance Management System and related standards, methods and processes in the companies.
Control/Monitor the implementation of the CMS in the companies; design, operation and further development of a reporting system for the CMS in the companies
Analyze risk entries and design, operation and continuous further development of a suitable reporting system
Perform quality checks on the Compliance Management System through on-site testing of compliance maturity levels in group companies
Monitor market developments regarding possible new risks and the Group in relation to legislative and technical changes
Degree in economics (Master’s degree, MBA)
Qualifications specific to compliance management; organizational development
Effective communication towards various target groups
Process orientation (practical knowledge about company common processes)
High level of comprehension and ability to grasp new facts quickly
Ability to take action independently and autonomously
Excellent analytical abilities
Keen sense of empathy
Flexibility and adaptability in a rapidly changing market
Working experience (in years):
Min. 5 years in auditing/change management or similar environment
Remarks (Language, IT-Knowledge, Certificates etc.):
Business-fluent English and Mandarin, German would be an advantage
Excellent knowledge of MS Office
